I'm calling the police, please get down, I don't want to shoot you (Nebraska)

11:30 Thursday night (January 24th), David Erives and his wife were inside their Omaha, Nebraska home when there was a pounding on the back door.

As Erives's wife went to answer the door, the man pounding on the door, 42-year-old Raul Rivas, tried to force his way into the house and grabbed the woman in a threatening manner. Police say it appears Rivas and the wife knew each other.

Seeing this, Erives grabbed his rifle and fired a single shot, striking Rivas in the knee. That didn't deter the attacker as he continued his violent behavior, lunging at Erives.



According to Douglas County Attorney Don Klein, "The individual with the gun says I'm calling the police, please get down, I don't want to shoot you, but he comes at him and the person with the rifle fires another shot and hits him in the chest".

Rivas was taken to Creighton University Medical Center where he died Friday morning.
