Punched in the face; Did he have the right to shoot in self defense (Kentucky)

Resource: http://www.kentucky.com/2013/11/12/2927398/georgetown-man-claims-self-defense.html
After being pushed by two women and punched in the face by a man in a road rage incident Sean Sampson, a resident of Georgetown, Kentucky drew his openly carried firearm and shot the assailant in the leg.

So why was he arrested and the guy that started it not? Police made it clear that Sean didn't have a CCW permit yet he was open carrying in accordance with the law.

"I am not a criminal. I am a law-abiding citizen who was defending himself," Sampson said, adding that he feared Huff had a weapon: "If these guys are coming at me and I still got my gun, apparently they have something on them as well."

Sometimes use of a gun is not always the best way to handle thing.

This would be an example of how gun owners should not be escalating. if these people were arguing at all id be like fuck it and walk away or sit in my car until the police showed up. the fact that he had a gun in his waste band means he should not have been getting into an argument.

Well, if you look into the details it was a road rage incident, the two women kept coming and the guy attacked him even seeing he was openly carrying a firearm. Given his position, I would have thought my attacked had a weapon as well so I don't see him as being at fault.

That said, it simply isn't worth the confrontation and it definitely would have been the better way to walk away.

As for pepper spray, I remember an article (I can't find it now) where one of the tactical instructors discussed carrying a mace blaster - a little pistol looking thing with two shots of pepper spray - as that intermediate option to avoid confrontation.

I carry pepper spray on a regular bases, if it can defuse a situation without me using a firearm as this guy did I will use it. after all its the lesser of the two evils
