Man killed with real .38 after brandishing toy gun at son's 1st birthday party (California)

MOUNTAIN GATE, CALIFORNIA - A man was shot and killed at his son's first birthday party in the Spring Branch Mobile Home Park Saturday afternoon (August 16th).

The still unidentified 38-year-old man went to the the home of Amanda Rizer, his ex-girlfriend and the mother of his child, for the boy's first birthday. Upon arriving, the man became furious that Rizer's new boyfriend, 32-year-old Matthew Robinson was at the party.

After a heated confrontation the father left the party but returned 20 minutes later and said he was taking his son from the home. 

Robinson drew his .38 caliber revolver and fired a warning shot as the father approached him aggressively. The father then ran to his truck and pulled what looked like a 9mm handgun (it was a toy) and took aim at Robinson.

Fearing for his safety, Robinson fired a single round into the father's chest. The father later died at Mercy Medical Center in Redding.

The father had an extensive criminal history and was out on bail pending court proceedings for being a felon in possession of a firearm, possessing controlled substances for sale and possessing stolen property.
